1. Acceptance of Terms

By accessing or using Helix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Helix is an AI-powered A/B testing platform that automatically generates, tests, and optimizes website copy. The Service includes a JavaScript snippet installed on your website, a management dashboard, and AI-driven copy generation.

3. Account Registration

You must create an account to use Helix. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to reverse-engineer the Service
• Use the Service to generate misleading, deceptive, or harmful content
• Exceed the usage limits of your subscription plan
• Share account credentials with unauthorized users
• Interfere with or disrupt the Service

5. Subscription and Billing

• Free tier accounts have no payment obligation
• Paid subscriptions are billed monthly via Stripe
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis within 30 days of purchase
• We reserve the right to change pricing with 30 days notice

6. Intellectual Property

• You retain ownership of all content on your website
• AI-generated copy variants become your property once generated
• The Helix platform, algorithms, and technology remain our intellectual property
• Copy DNA profiles and test analytics are associated with your account

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for temporary outages due to maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, Helix shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost revenue from A/B test results.

10. BYOK (Bring Your Own Keys)

If you use your own API keys for AI providers:

• You are responsible for the costs incurred with those providers
• Helix encrypts your keys using AES-256 encryption
• We do not access your keys for any purpose other than generating variants on your behalf

11. Termination

We may suspend or terminate your account if you violate these terms. Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
